Conditions....and in english

1. I understand that, unless stated on this agreement that credit will not be extended to me after the completion of this website. After this, $15 per day interest applies.

2. All monies due under this agreement are payable only at the offices of The Website Workshed (where this contract shall be deemed to be performed and executed).

- Pay me by cheque, cash or direct bank deposit.

3. I agree that a letter from The Website Workshed and purporting to be signed by the manager or proprietor or other person having authority to sign such a letter shall be admissible and accepted as prima facie evidence of the completion of the website in any proceedings brought in respect of this contract. This contract shall be deemed to have been made at the time of the signing of this order.

4. The Website Workshed will not be liable for any loss of damage occasioned by errors or delays in completion of the website.

5. If the client does not provide copy after 7 days have elapsed after the deadline date, The Website Workshed may, in order to meet the deadline commitment, itself prepare copy and material for use in the website and insert it without incurring any liability of any description towards the client.

- I need info and the sooner the better

6. Cancellations, if accepted by the company will carry a cancellation fee of 20% of all monies owing to the company as listed in the agreement.

- Pay up even if you change your mind.

7. A production charge will apply for addional artwork resulting from alterations to website requested by the client after the initial website has been created and produced into a completed form. No charge will bemade for corrections requested which are consistent with the original layout.

- Extra work costs you money.

8. This agreement begins with the initial payment of 50% of the total due (not including the Entry Level Package - which requires payment in full before work begins). The remainder will be due on completion of the website three months or sooner after signing of the contract unless otherwise stated on the form. The Website Workshed will not be held responsible for late completion due to the client not providing material and artwork within the first 7 working days of the signing of the contract.

9. Changes requested by the client beyond those limits will be billed at the hourly rate of $79.00 worked at 15 minute segments. This rate shall also govern additional work authorised beyond the maximum specified above for such services as general internet orientation, education, marketing consulting, web page design, editing, modifying product pages and databases in an online store and art, photos, graphic services and helping clients learn how to use their own website.

10 The registered domain name on behalf of the client will remain the property of the client after payment of the completed website.

- You keep the domain name.

11. The named client of the contract is engaging The Website Workshed, located at 239 Queen Street, Bendigo VICTORIA 3550, as an independent contractor for the specific project of developing and/or improving a website to install on the clients webspace of The Website Worksheds hosting servers. The client hereby authorises The Website Workshed to access this account, and authorises ‘write permission’ for the client’s webpage directory, cgi-bin directory, and any other directories or programs which need to be accessed for this project. The client also authorises The Website Workshed to publicize their completed website to Web Search Engines as well as other Web directories and indexes.

12 The Website Workshed does not warrant that the functions contained in these web pages or the internet website will meet the clients requirements or that the operation of the web pages will be uninterrupted or error free. The entire risk as to the quality and performance of the web pages and website is with the client. In no event will The Website Workshed be liable to the client or any third party for any damages, including any loss of profits, lost savings or other incidental, consequential or special damages arising out of the operation of or inability to operate these web pages or website, even if The Webiste Workshed has been advised of the possibility of such damages. If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
